General Terms and Conditions

Scope of Application of the GTC

1.1. The "one world cooperation (owc)" - Association for the Support of One World Cooperation (private) Limited, Sri Lanka (in short "one world cooperation (owc)") operates a webshop (in short "Webshop") under the domain https://slphotocollective.com, for which these General Terms and Conditions (GTC) apply.

1.2. These General Terms and Conditions (hereinafter referred to as "GTC") shall apply exclusively to the submission of orders (for more details, see section 3) and to all legal transactions concluded in connection with the webshop. By submitting the order in the web store, the customer expressly declares that these GTC become part of the contract for the respective legal transaction.

1.3.  Even repeated orders do not make these GTC a permanent part of the contract between the customer and one world cooperation (owc); in particular, one world cooperation (owc) may change or modify the GTC at any time.

1.4.  One world cooperation (owc) hereby expressly rejects any other terms and conditions of the customer. Deviating terms and conditions of the customers shall only apply if one world cooperation (owc) agrees to their validity in writing.

Requirements for the Customer

2.1.  Orders are only possible after prior registration (i.e. disclosure of the required data) and are exclusively reserved for persons who have already reached the age of 18.

2.2.  By registering or placing an order, the customer confirms that he/she has reached the required minimum age and that the registration or order data is correct and complete.

Conclusion of Contract

3.1.  The presentation of products in the web store is not a binding offer by one world cooperation (owc). Rather, they represent a non-binding product range (i.e. those goods that are basically distributed by one world cooperation (owc)). However, one world cooperation (owc) expressly reserves the right to make corrections to the stock of goods indicated in the web store and cannot exclude the possibility that, in particular for technical reasons, the indicated availabilities are not correctly represented.

3.2.  By the customer's order (i.e. confirmation by clicking the order button with the inscription "Order subject to payment"), the customer makes a binding offer to one world cooperation (owc) for the products selected by him and subsequently visible in the order form.

3.3.  One world cooperation (owc) is legally obligated to immediately electronically confirm the receipt of this contractual declaration (i.e. the order) to the customer. This is done by an automated confirmation e-mail about the receipt of the order. This confirmation e-mail is not a declaration of acceptance.

3.4.  One world cooperation (owc) is not obliged to accept the customer's offer. If one world cooperation (owc) rejects the customer's offer, one world cooperation (owc) will inform the customer without unnecessary delay.

3.5.  One world cooperation (owc) can accept the offer either by a separate declaration of acceptance (e.g. by e-mail) or by actual delivery of the ordered products. In the latter case, one world cooperation (owc) will send the customer information (e.g. by e-mail) about the successful shipment.

Prices

4.1.  The prices shown in the web store at the time of the order shall apply exclusively to the order.

4.2.  The prices are gross prices (i.e. including VAT and all other taxes and surcharges). Any delivery costs are not included in the prices shown (see point 6).

4.3.  Despite all care taken by one world cooperation (owc), it cannot be completely ruled out that incorrect prices (e.g. due to input errors) for individual products are displayed in the web store by mistake. If the customer has already placed an order, one world cooperation (owc) will inform him about the actual price and the customer can then confirm his offer at the actual price or declare that he is no longer interested in the order.

Payment

5.1.  The total price (i.e. purchase price plus any delivery costs) shall become due upon conclusion of the contract (for more details see section 3) and may be paid by the customer using the payment methods offered upon conclusion of the contract.

More detailed information on the respective payment terms and any costs incurred by the payment service providers will also be presented to the customer in detail before the order is placed.

5.2.  The delivered goods shall remain the property of one world cooperation (owc) until payment has been made in full (retention of title).

5.3.  By placing an order, the customer agrees that one world cooperation (owc) issues invoices in an electronic format and sends them to the customer (so-called "electronic invoice" as defined by § 11 para. 2 UStG). The customer waives the postal delivery of the invoice (i.e. a paper invoice) and agrees to the delivery of the electronic invoice by e-mail.

Delivery and Shipping Costs

6.1.  The one world cooperation (owc) endeavors to carry out the production and delivery of the products after the conclusion of the contract (more details in point 3) without unnecessary delay. However, depending on the product ordered, delivery may take some time. If no other agreement has been made with the customer or if one world cooperation (owc) does not announce another delivery time before conclusion of the contract, one world cooperation (owc) will have the ordered product delivered to the customer.

6.2.  Delivery shall be made to the delivery address specified by the customer in the order. The customer is obligated to notify a change of his contact data (in particular address and e-mail address) without delay as long as a legal transaction relevant to the contract has not been mutually fulfilled. Until this point in time, one world cooperation (owc) may address legally relevant declarations with legal effect to the contact data originally provided by the customer.

6.3.  Depending on the delivery address of the customer, the delivery is carried out by different shipping service providers, to whom the e-mail address and telephone number of the customer are disclosed in addition to the delivery address in order to fulfill the delivery service.

6.4.  One world cooperation (owc) is entitled to make partial deliveries even when ordering several products or a product consisting of several parts.

6.5.  If delivery to the customer is not possible because the customer cannot be found at the specified delivery address or because the delivery address was not specified correctly, the customer shall bear the costs for the unsuccessful attempt to deliver and the costs incurred by one world cooperation (owc) for a return shipment.

6.6.  The one world cooperation (owc) retains ownership of the products even after delivery to the customer until full payment of the delivered products.

6.7.  All customs fees, duties and delivery charges shall be borne by the Customer and shall be imposed on the Customer either as part of the order or as part of the delivery.

Warranty

7.1.  The images of the products offered via the webshop are purely symbolic and color deviations in particular cannot be ruled out due to different browser displays.

7.2.  The one world cooperation (owc) assumes no liability with regard to the correctness of the measurements given by the customer.

7.3.  One world cooperation (owc) warrants, in accordance with the statutory provisions, that the products are free from defects at the time of delivery, i.e. one world cooperation (owc) warrants that the products have the characteristics stipulated or usually assumed, that they correspond to the description and that they can be used in accordance with the nature of the transaction or the agreement made.

7.4.  Warranty claims for products that can be purchased via the webshop expire two years after delivery.

If the defect becomes apparent within six months of delivery, it shall be presumed that the defect was already present at the time of delivery. After six months, the customer must prove that the defect was already present at the time of delivery, at least in principle.

7.5.  In the event of a defect, the customer may initially choose between improvement or rectification of the defect and replacement of the item. One world cooperation (owc) will effect this within a reasonable period of time and with the least possible inconvenience for the customer. If the improvement or replacement is impossible or would involve a disproportionately high effort for one world cooperation (owc) compared to the other remedy (depending on the value of the defect-free item, the severity of the defect and the inconvenience associated with the other remedy for the customer), the customer has the right to a price reduction or conversion (i.e. cancellation of the contract). However, the right to rescission exists only if the defect is not minor.

7.6.  If the customer is an entrepreneur as defined by the Austrian Commercial Code (UGB), he shall notify us within a reasonable period of time pursuant to § 377 UGB of any defects in the products which he has discovered or should have discovered by examination in the ordinary course of business after delivery. Otherwise he shall be subject to the consequences of §§ 377 ff UGB.

Liability for Damages

one world cooperation (owc) shall only be liable for damages in connection with the performance of the contract if one world cooperation (owc) or persons attributable to one world cooperation (owc) (i.e. assistants) act intentionally or with gross negligence. This exclusion of liability for slight negligence does not apply to personal injury (i.e. one world cooperation (owc) is also liable for this in the event of slight negligence).

Declaration about the Use of Data – Privacy Policy

9.1.  For correspondence with the customer or for the smooth fulfillment and execution of the contract (i.e. for registration, processing of orders, delivery of products, and processing of payments, examination of claims asserted against one world cooperation (owc) after fulfillment of the contract, etc.), one world cooperation (owc) requires some personal data. The protection of this data and the personal rights of the customers are very important to one world cooperation (owc). Therefore, one world cooperation (owc) adheres to the most modern security standards to ensure the protection of the data and uses (i.e. processes or transmits) the data exclusively within the framework of the legal regulations. The data used is treated as strictly confidential.

9.2.   During the registration required for the order (see point 2.), the title, salutation (i.e. gender), name, address (i.e. delivery or billing address), date of birth and e-mail address are requested and stored by one world cooperation (owc). In addition, the customer can also voluntarily provide his telephone number, which will then also be stored.

In the course of the order, information about the ordered products and payment information (i.e. credit card information, account data or other payment data) is also stored.

9.3.  The one world cooperation (owc) uses this personal data for the following purposes:

-checking the requirement for registration or ordering in the web store (especially meeting the age requirement);

-correspondence with the customer in connection with the order and processing of the contract. For this purpose, the address data of the customer will also be passed on to selected logistics partners;

-Sending electronic information material about the product range (such as offers and news) and events or supported events.

9.4.  This use of personal data may be revoked at any time, to the extent permitted by law. Revocations can be made as follows:
